Main duties and responsibilities:

To provide legal advice as necessary to other officers, to other directorates, to members of the Council and generally to members of the public.

To undertake litigious matters on behalf of the Council, including representing the Council as an advocate in the Magistrates� and County Courts.

To provide legal advice and assistance to the Licensing section, including the preparation and conduct of licensing committee hearings, as required from time to time.

To consider requests for planning enforcement and building regulation enforcement action and to prepare any necessary statutory and court documentation, including undertaking any subsequent prosecutions in the Magistrates� Court. To provide support during planning inquiries.

To consider requests for Anti-Social Behaviour Orders and to advise the Anti-Social Behaviour Officer on the gathering and presentation of evidence and witness statements in support of such applications. To prepare any necessary statutory and court documentation, including undertaking any subsequent application hearings for ASBO�s in the Magistrates� Court.

To consider and give advice on requests for welfare benefits fraud prosecutions and to prepare, initiate and conduct any subsequent prosecutions in the Magistrates� Court.

To draft and administer Simple Cautions, as required.

To provide legal advice on Housing and Leasehold matters, including to give advice on Disabled Facilities Grants and grants to the disabled, to give advice on claims in possession and abandonment and to prepare, initiate and conduct any subsequent claims in possession in the County Court.

To attend committee or sub-committee meetings of the Council as the representative of the Director of Legal and Planning, as required from time to time.

To undertake non-contentious planning matters, such as amendments to planning Agreements under section 106 of the TCPA 1990, as required.

To undertake the conveyance work of the Council, including compulsory purchase and vesting declarations.

To be responsible for the sale of Council houses and flats under the Right to Buy provisions.

To be responsible for the preparation and drafting of statutory and other documentation in the declaration of Local Nature Reserves. To provide general legal advice on Local Nature Reserves.

To be responsible for the preparation and drafting of statutory and other documentation in the making of Orders of the Council, such as Off-Street Parking Orders. To provide general legal advice on the procedures for implementation and enforcement of such Orders. To liaise with officers of other local authorities on the implementation of such orders.
